1. Subject matter and scope

These Terms of Service (hereinafter, the Terms) govern access to and use of the out-of-court flight passenger claim management service offered by Avyron Legal Tech (hereinafter, Avyron) through the website avyronlegaltech.net.

Use of the service constitutes full and unconditional acceptance of these Terms. If you do not agree with any of these conditions, you must refrain from using the service.

Avyron reserves the right to amend these Terms at any time, giving at least 15 days' notice through the website or by email. Continued use of the service after notification implies acceptance of the changes.

2. Service description

Avyron is an out-of-court flight passenger claim management platform operating under Regulation (EC) No 261/2004 of the European Parliament and of the Council (hereinafter, EC 261/2004). Through an AI agent system, Avyron assesses the viability of the claim, generates the necessary communications, and manages contact with the airline and, where necessary, the national regulator.

The service comprises the following management stages:

  • Β·Eligibility and viability assessment of the claim under EC 261/2004
  • Β·Automatic generation of the claim letter and rights assignment document
  • Β·Sending the communication to the airline via the available channel (email, certified email, or postal)
  • Β·Monitoring the airline's response (30-day deadline from sending)
  • Β·Escalation to the national regulator (AESA or equivalent) if the airline does not respond or denies compensation without justification
Avyron is not a law firm. The service Avyron provides is out-of-court: it manages claims with the airline and the national regulator on behalf of the passenger, following assignment of rights. The final outcome of the claim depends on the airline and/or the competent national regulator.

3. Users and access conditions

3.1 Users (passengers)

The user must be at least 18 years old (or act under the supervision of a legal guardian) and be the passenger or beneficiary of the affected flight. To initiate claim management, the user must: (i) provide the details of the affected flight and their contact information; (ii) sign the rights assignment to Avyron Legal Tech, authorising Avyron to act on their behalf with the airline and the regulator; (iii) confirm that the information provided is truthful and corresponds to a real flight. The provision of the service is conditional on signing the rights assignment.

3.2 Rights assignment

By accepting the claim management service, the passenger assigns to Avyron Legal Tech the rights arising from their claim under EC 261/2004, on an exclusive and temporary basis, during the active management period. This assignment: (i) enables Avyron to act on behalf of the passenger with the airline and the national regulator; (ii) is formalised by a PDF document generated at the start of the case, communicated to the passenger, and stored in Avyron's systems; (iii) may be revoked at any time by written notice to business@avyronlegaltech.net, provided there is no active management with the regulator that prevents separation without prejudice to the passenger.

4. Acceptable use

The user agrees to use the service lawfully and in good faith. The following are expressly prohibited:

4.1 False data

Entering fictitious, inaccurate or third-party flight data without their consent in order to obtain fraudulent claim management.

4.2 Parallel claims

Initiating simultaneous management of the same claim through another service or firm without notifying Avyron, while the rights assignment is active.

4.3 Reverse engineering

Attempting to decompile, disassemble or extract the source code, algorithms or models that make up the Avyron system.

4.4 Misleading presentation

Presenting communications generated by Avyron as formal legal advice, a judgment, or a binding decision by any authority.

4.5 Direct acceptance without notification

Accepting a payment or compensation directly from the airline related to the managed claim without notifying Avyron, while the rights assignment is in force.

5. Nature of the service and limitation of liability

5.1 Automated system with supervision

Management is carried out by an artificial intelligence system combining deterministic analysis based on EC 261/2004 and CJEU case law with a large language model. Communications sent to airlines and regulators are reviewed by Avyron before sending.

5.2 No guaranteed outcome

Avyron applies the best available standards in claim management, but cannot guarantee that compensation will be obtained in all cases. The final decision lies with the airline and/or the national regulator. Case law on passenger rights is constantly evolving.

5.3 Limitation of liability

Avyron shall not be liable for the airline's or regulator's rejection of a claim, including without limitation: loss of expected compensation or additional costs incurred by the passenger. Avyron's total liability to the passenger in the event of a management error attributable to Avyron shall be limited to a refund of the commission charged in that specific case.

5.4 Right to human review

In accordance with Art. 22 GDPR, the user has the right to request human review of any automated decision affecting them, express their point of view, or object to the result by writing to business@avyronlegaltech.net. Avyron will respond within a maximum of 15 working days.

6. Intellectual property

All elements comprising the Avyron service β€” including the analysis engine, source code, algorithms, design, texts, and brand β€” are the exclusive property of Avyron Legal Tech and are protected by applicable intellectual property law.

The user retains all rights over the flight data they enter into the system. Avyron may use anonymised data (without personal identifiers) to improve the accuracy of the analysis engine.

The communications and documents generated by Avyron within the claim management process are for the exclusive use of the passenger and Avyron for claim management purposes. Their use for other purposes without Avyron's authorisation is prohibited.

7. Commission and billing

Fee modelNo win, no fee β€” Avyron only charges if the passenger receives compensation
Commission15% of the compensation amount actually received, plus VAT (21%)
Indicative exampleEC 261/2004 compensation of €400 β†’ commission €60 + VAT €12.60 = total €72.60 deducted from compensation
BillingAvyron issues an invoice at the time the compensation is effectively received by the passenger
PaymentAvyron deducts its commission before transferring the net amount to the passenger, or the passenger pays the commission within 7 days of receiving direct compensation
VATCommission subject to VAT at the applicable rate (currently 21%). Avyron issues invoices as a sole trader under Spanish tax law

The 15% + VAT commission applies exclusively to the monetary compensation received. If the airline offers a voucher or other non-monetary solution, Avyron does not charge a commission unless the passenger expressly accepts it and it was managed by Avyron.

8. Termination of service

8.1 By Avyron

Avyron may cancel case management in the event of: breach of these Terms by the user, false or fraudulent data, a parallel active claim with another manager, or a requirement from a competent authority. In the event of cancellation, Avyron will inform the passenger of the reason and the status of the case.

8.2 By the passenger

The passenger may revoke the rights assignment and cancel management at any time by written notice to business@avyronlegaltech.net, at no cost, provided there is no active management with the regulator preventing separation. If a communication has already been sent to the airline, Avyron will notify the closure of the file.

8.3 Effects of termination

Upon termination, Avyron will cease active management and inform the passenger of the final case status. Stored data will be retained in accordance with the Privacy Policy.

8b. Right of withdrawal

As a consumer, you have the right to withdraw from this contract within 14 calendar days without providing any reason and without penalty, in accordance with Art. 102 of the Spanish Consumer and User Protection Act (TRLGDCU).

However, by submitting your claim and signing the rights assignment, you expressly request that Avyron begin providing the service immediately β€” before the end of the withdrawal period β€” and acknowledge that once the first communication has been sent to the airline on your behalf, the right of withdrawal will be extinguished (Art. 103.a TRLGDCU). If you wish to cancel before that communication is sent, you may do so at any time at no cost by writing to business@avyronlegaltech.net.

9. Privacy and data protection

The processing of personal data in the context of use of the service is governed by the Avyron Privacy Policy, which forms an integral part of these Terms.

In the context of claim management, Avyron processes passenger identification data (name, email, and DNI/NIE if provided), flight data, and the rights assignment document. The passenger may exercise their GDPR rights at any time by writing to business@avyronlegaltech.net.

10. Applicable law and jurisdiction

These Terms are governed by Spanish and European Union law. In contracts with consumers, the competent jurisdiction shall be that of the consumer's domicile, in accordance with mandatory consumer protection rules that cannot be waived by agreement. Both parties may also use available alternative dispute resolution (ADR) mechanisms.

For disputes with consumers (end users), the European Commission offers an online dispute resolution (ODR) platform accessible at ec.europa.eu/consumers/odr.
